On July 6, 2026, WLF urged the Fourth Circuit to affirm the dismissal of antitrust claims brought against pharmaceutical company Amgen over patents for “etanercept,” a molecule used to treat arthritis. WLF contends that the lower court correctly rejected Sandoz’s attempt to relitigate issues already resolved in prior litigation involving those patents. A contrary ruling, the brief explains, would invite collateral attacks on final judgments, encourage duplicative litigation, and undermine the certainty essential to the patent system.
