Montgomery v. Caribe

On May 14, 2026, the U.S. Supreme Court determined that a federal law regulating brokers (who match interstate and international shippers with delivery services) and motor carriers (the commercial trucking companies who deliver the shipper’s goods after being chosen by a broker) does not preempt a state tort claim for negligent hiring by a broker. This was a setback for WLF, whose brief argued that federal preemption would prevent pernicious regulation-by-litigation in the state courts.
