On June 17, 2025, WLF urged the Ninth Circuit to affirm the district court’s issuance of judgment as a matter of law in an antitrust case brought by subscribers to the NFL’s “Sunday Ticket,” a service that allows viewers to watch NFL games from across the country for a fee. As WLF’s amicus curiae brief makes clear, judgment as a matter of law was the best remedy after the district court determined that it had inappropriately let in expert testimony that directly led to the jury’s issuance of a “nonsensical” multi-billion-dollar judgment. WLF’s brief also contends that affirmance will promote important judicial economy interests, while reversal will incentivize district courts to leave the fixing of evidentiary errors to the appellate courts—delaying justice for future similarly situated defendants.
