On June 29, 2026, WLF urged the Supreme Court to grant certiorari and overrule PruneYard v. Robins. As WLF’s brief explains, PruneYard is an outlier First and Fifth Amendment precedent that has been bypassed by the Court’s subsequent caselaw. But PruneYard is also dangerous—the go-to citation for governments that wish to compel commercial speech and association or take property without paying for it.
