On June 18, 2025, WLF urged the Supreme Court to grant certiorari before judgment in a challenge to tariffs imposed by President Trump under the International Emergency Economic Powers Act (IEEPA). As WLF’s amicus curiae brief makes clear, IEEPA does not give the President any legal basis to impose tariffs, and the administration’s strained reading to the contrary violates the major questions doctrine. WLF argues that the Court should grant certiorari now, given that further delay on this multi-trillion-dollar question will unnecessarily increase business uncertainty for every business in America that is even remotely affected by international trade.
