In re Ultra-Processed Food Definition

On September 23, 2025, WLF filed comments urging FDA to abandon any plans to create a federal definition of “ultra-processed foods.” WLF’s comments noted that such a definition would inevitably be both over- and under-inclusive and would fail to take into consideration the nutrient content of food. WLF also argued that any subsequent effort to introduce a federal definition of “ultra-processed foods” for use on nutrition labeling would violate the First Amendment.
