An excellent post is up this morning on Hyman, Phelps & McNamara‘s FDA Law Blog discussing the amicus briefs filed in a private antitrust challenge to the settlement of a generic drug company’s patent lawsuit against the maker of potassium-deficiency drug K-DUR.  The amicii supporting the plaintiffs include the Federal Trade Commission, which has been on the losing side in nearly all private and government challenges to what FTC calls “pay-for-delay” settlements.
