On January 17, 2024, the Fifth Circuit reversed a District Court order declaring the Consumer Product Safety Commission’s structure unconstitutional. This was a disappointment for WLF, which filed an amicus brief supporting the challengers. WLF’s brief highlighted that principal officers of the United States cannot enjoy for-cause removal protections except in limited circumstances not relevant to the CPSC.
