On March 21, 2022, WLF urged the Fourth Circuit to follow the Supreme Court’s TransUnion v. Ramirez decision by denying uninjured class members standing to sue. The case returns to the court after remand from the U.S. Supreme Court. As WLF’s brief shows, allowing uninjured class members to recover is inconsistent with TransUnion. The brief also explains how granting summary judgment and class certification in the same order violates all parties’ due-process rights. WLF urges the Fourth Circuit to reverse the class-certification order.
