A district court has found that Google willfully engaged in a series of anticompetitive acts to acquire and maintain monopoly power in the publisher ad server and ad exchange markets for open-web display advertising. Is the district court’s decision likely to withstand appellate scrutiny? What remedies might the DOJ seek? What factors will constrain the court’s remedy decision? Our panel of experts will discuss the ruling’s impact on Google and on the FTC/DOJ big-tech litigation docket.

Speakers' Biographies

Bilal Sayyed

Bilal is Senior Competition Counsel with TechFreedom. He was most recently the Director of the Office of Policy Planning at the Federal Trade Commission (2018-2021). Prior to his time at the Commission, Bilal was an attorney in private practice, representing clients in merger and non-merger matters before the FTC and Department of Justice, and in consumer protection matters before the FTC. He also taught antitrust law as an adjunct professor at the Antonin Scalia Law School at George Mason University and was an attorney advisor for FTC Chairman Timothy Muris (2001-2004). Bilal also serves as Counsel to Cadwalader Wickersham & Taft in its Washington, DC office.

Giovanna Massarotto

Giovanna is CTIC Research Fellow at the University of Pennsylvania Carey Law School. Her scholarship focuses on how technology affects society and the intersection of law, economics, and computer science. Before arriving at Penn, Giovanna was a visiting research fellow at Fordham University in New York and then worked in Washington, D.C., for an economic consulting firm specializing in intellectual property law, economic regulation, and antitrust in the telecommunications and high-tech industries.

Derek W. Moore

Derek is Counsel with Rule Garza Howley in the firm's Washington, D.C. office. He held numerous positions during nearly a decade at the Federal Trade Commission, including Attorney Advisor to a Commissioner, Attorney Advisor in the Office of Policy Planning, and Staff Attorney (on detail) in the Technology Enforcement Division of the Bureau of Competition. Derek served as a law clerk to D.C. Circuit Judge Robert H. Ginsburg and U.S. District Court for the Eastern District of Virginia Judge Claude M. Hilton.

Daniel J. Gilman

Dan is a senior scholar of competition policy at International Center for Law & Economics (ICLE). Before joining ICLE, Dan was an attorney advisor in the Federal Trade Commission’s (FTC) Office of Policy Planning, where he worked on competition issues in health-care and technology markets and, more broadly, on the competitive impact of regulation, with a focus on privacy regulations, among others. During the 2014-15 academic year, while on leave from his FTC duties, he visited Harvard Law School as the Victor H. Kramer Foundation Fellow in antitrust law and economics.
