On April 29, the U.S. Supreme Court will hear oral arguments in a case where the Ninth Circuit allowed a class action to proceed even though many class members suffered no injury and thus lacked Article III standing to sue. The Court’s decision will resolve a split in the federal circuits and could substantially alter the class-action device and how courts assess class certification. Our panelists will explain the case, assess the issues the justices will consider, offer thoughts on what to watch for during oral argument, and analyze the decision’s potentially broader impact.
