INTRODUCTION

In 2020, we authored a WLF Legal Backgrounder on the significant personal injury and property damage lawsuits involving per- and polyfluoroalkyl substances (“PFAS”) that have been decided so far or are still pending. We revisit the topic in this Working Paper. As this article’s title indicates, with a nod to the 2023 Academy of Motion Picture Arts and Sciences’ Best Picture, recent PFAS litigation involves more PFAS chemicals, at lower detection limits, and with expanded legal theories (everything) at more sites—including those of downstream product manufacturers and processors that use PFAS in manufacturing products—and in more consumer products (everywhere), at an increased pace (all at once). …..
