Description:
After recent developments at the U.S. Supreme Court, state and local climate-change-related lawsuits will now head to state courts around the country, with potentially more tort and consumer protection claims to follow. Our panelists will survey the climate litigation landscape; discuss whether this case-by-case approach, as well as the use of novel legal theories, is a viable climate-protection strategy; and assess available alternative approaches that cities and states could pursue.

Speakers' Biographies

Phil Goldberg

Phil is office managing partner of Shook, Hardy & Bacon L.L.P.'s Washington, DC office and is co-chair of its Public Policy Practice Group. In 2015, Phil worked with the Progressive Policy Institute to establish its Center for Civil Justice, which provides a center-left voice on important civil justice issues. In 2019, he was named special counsel to a project of the National Association of Manufacturers, the Manufacturers Accountability Project to educate the public policy and legal community on why litigation against energy manufacturers over climate change is misguided. In 2020, the International Association of Defense Counsel tapped him as chair of the group’s Amicus Committee. He also has been a member of the American Law Institute since 2012, providing input on several Restatement projects.

Jeremy Harrell

Jeremy is the Chief Strategy Officer at ClearPath, where he leads the development, management, and execution of the organization’s strategic plan. In that role, he oversees the organization’s public policy development, government affairs, research, and strategic partnerships, including philanthropic initiatives. Jeremy serves as a member of the U.S. Department of Commerce’s Renewable Energy and Energy Efficiency Advisory Committee (REEAC). He also plays a leadership role in multiple clean energy industry trade groups, serving as the Chairman of the U.S. Nuclear Industry Council, a leading advocate for American nuclear energy technologies, and Legislative Chair for Geothermal Rising, the largest association for geothermal energy professionals. He is a frequent commentator on clean energy innovation.

Sarah E. Hunt

Sarah is President of the Joseph Rainey Center for Public Policy, where she leads public policy research and leadership development programs by and for women, minorities, and mavericks. Prior to founding the Rainey Center, Sarah launched a clean energy program at the American Legislative Exchange Council and a climate change program at the Niskanen Center. Early in her career she served as Manager, State Issues and Ethics Officer at the consulting firm Stateside Associates and practiced political law at a boutique law firm in the Pacific Northwest.
