About the program:

“Citizen suits” challenging environmental emissions permits have become regrettably commonplace for enterprises engaged in major energy, transportation infrastructure, and other large projects. One such permit challenge aimed at the Keystone XL pipeline led to an unprecedented injunction against issuance of a general, nationwide water permit. Our speakers will discuss the ongoing appeal of that injunction, the legal, economic, and broader policy impacts of the suit, and other developments related to the disruption caused by activist litigation.

Speakers' Biographies

Lindsay S. See

Ms. See is Solicitor General for the State of West Virginia, where she manages appellate and high-stakes litigation for the State in both state and federal courts. Her work also focuses on regulatory and administrative law issues, as well as leading and working with multi-state coalitions on a variety of national issues. Ms. See previously clerked for the Hon. Thomas B. Griffith on the U.S. Court of Appeals for the DC Circuit, then spent several years practicing appellate and administrative law with Gibson, Dunn & Crutcher LLP in Washington, DC.

Lawson Fite

Mr. Fite is General Counsel of the American Forest Products Council, a regional trade association located in Portland, OR. Mr. Fite began his career as a Trial Attorney in the Wildlife and Marine Resources Section of the U.S. Department of Justice, focusing on litigation under the Endangered Species Act and other environmental statutes. He successfully represented the Coast Guard in an ESA challenge to efforts to respond to the Deepwater Horizon spill. Immediately prior to joining AFRC, Mr. Fite was in private practice with a commercial litigation boutique. He gained first-chair trial and appellate experience.

Thomas Jackson

Mr. Jackson is Special Counsel with Baker Botts L.L.P. in the firm's Washington, DC office. He handles all aspects of environmental law, including client counseling, permitting, trial court and appellate litigation, administrative hearings and arbitrations and legislative matters. Mr. Jackson has substantial experience in advising corporations and other business entities on the federal regulation of natural resources, particularly the regulation of water, wetlands and endangered species.
