Washington Legal Foundation’s Chief Counsel, Rich Samp, authored a commentary published today on SCOTUSblog as part of symposium on United States v. Texas, a case the Supreme Court will consider during its current term regarding the Obama Administration’s deferred-action policy for immigration. Rich argues that the Court can decide the case solely on the grounds that the government violated the Administrative Procedure Act by failing to subject its policy to notice-and-comment rulemaking.
