As we noted in our Keeping Amici Out of Rubashkin? post a week ago,  the federal government has been subjected to deserved criticism for its aggressive opposition to amicus briefs filed by Washington Legal Foundation, the ACLU of Iowa, and the National Association of Criminal Defense Lawyers in the appeal of a criminal case, Rubashkin v. U.S.  Perhaps prosecutors saw the error of their ways, because the U.S. Attorney’s office in Iowa withdrew its objections today to the briefs.
