Wightman v. Consolidated Rail Corp.
On November 14,1997, WLF filed a brief in the Ohio Supreme Court, urging the court to review a lower-court judgement ordering a railroad to pay $15 million in punitive damages to the family of a teenager who was killed in a collision between her car and a train. WLF argued that the judgement was clearly excessive, given that the deceased had driven around a lowered crossing gate in order to reach the tracks where the collision occurred. WLF also noted that the punitive damages award was 6,250 times greater than the $2,400 in compensatory damages awarded to the deceased's family for damage to her car.
