City of Monterey v. Del Monte Dunes at Monterey, Ltd.

On July 31, 1998, WLF filed a brief with the Court on behalf of itself and the Allied Educational Foundation urging the Court to uphold an important property rights decision from the U.S. Court of Appeals for the Ninth Circuit. The court of appeals affirmed a jury verdict finding that the City of Monterey was liable in damages for effectively taking private property for public use without just compensation under the Fifth Amendment of the U.S. Constitution.
