Rhyne v. Kmart Corp
On April 2, 2004, the North Carolina Supreme Court upheld a North Carolina tort reform law that imposes limits on punitive damage awards. WLF had filed a brief supporting the law, which limits punitive damage awards to the greater of $250,000 or three times the compensatory damages. The court agreed with WLF that the law is a reasonable legislative response to runaway damage awards and violates neither the U.S. Constitution nor the North Carolina Constitution.
