On June 9, 2003, the U.S. Supreme Court announced that it was equally divided in this case, which raised the issue of whether absent class members in a class action should be permitted to relitigate final judgments entered in the lawsuit. The 4-4 vote means that the issue remains undecided until another case raising similar issues comes along. WLF had filed a brief in the case, urging the Court to bar collateral attacks on class actions judgments that have become final. The case involves a challenge to the 1983 settlement of all claims arising from the exposure of Vietnam veterans to the herbicide Agent Orange.
